What is a Broker of Record in New York and why do I need one?
A Broker of Record (also called a Supervising Broker) is the licensed real estate broker who holds supervisory and compliance responsibility for all real estate activity conducted under a brokerage. New York Real Property Law Article 12-A (§§440-443) requires that every brokerage operate under a licensed broker registered with the New York Department of State (NYSDOS).
The Broker of Record must hold an active New York real estate broker license, maintain 22.5 hours of continuing education every two years (including fair housing, agency, ethics, and implicit bias training), and ensure the brokerage's operations comply with state law. If your company buys, sells, leases, manages, or facilitates real estate transactions in New York, you need a Broker of Record to operate legally.
Does my PropTech platform need a real estate license in New York?
If your platform facilitates, coordinates, or earns compensation from real estate transactions, it almost certainly requires broker licensing. New York's definition of brokerage activity under Real Property Law §440 is broad — it covers listing, selling, buying, exchanging, leasing, rent collection, and negotiating loans secured by real property. Referral activity for compensation also triggers licensing requirements.
This applies to iBuyer platforms, fractional ownership products, property management technology, SFR acquisition programs, short-term rental platforms, and mortgage technology companies. The NYSDOS can pursue enforcement actions, fines, and license revocation for unlicensed activity.
What is the difference between a Broker of Record and an Associate Broker in New York?
A Broker of Record is the principal broker who holds supervisory and compliance responsibility for the brokerage. An Associate Broker is a licensed broker who chooses to work under the supervision of another broker, similar to a salesperson. Under RPL §440(2), an associate broker retains their broker license but operates under the brokerage's name and supervision. New York also recognizes Office Managers — associate brokers with at least two years of active associate broker experience who supervise a branch office (RPL §440(6)).
What are the escrow and trust fund requirements in New York?
New York requires that brokers maintain escrow accounts for client funds, separate from the broker's personal or operating accounts. The Broker of Record is responsible for proper handling, accounting, and disbursement of all escrow funds. Commingling client funds with broker funds is a violation that can result in license suspension or revocation.

Does New York offer real estate license reciprocity?
No. As of February 2023, New York no longer offers real estate license reciprocity with any other state. All brokers and salespersons must complete the full New York licensing requirements, including pre-licensing education, the state exam, and a sponsoring broker relationship. This makes having a New York-licensed Broker of Record essential for out-of-state companies entering the New York market.
